Is duplicate content in my footer hurting my rankings?

    The way my site was designed, all the text goes into the footer, so if I am optimizing the homepage, it changes all the pages. I have several paragraphs and am wondering if this could be hurting my rankings. Could you do a fellow seo workaholic a favor and have a look and tell me what you think.

    Matt Cuts says to use different page to use common paragraphs and give it a link. for a example don't paste privacy in every page footer, use new page and post privacy and give it a link from footer.

    I'm stuck at a #4 position, everything about my site is better than the competition (except age) but they are ranking better. It's the only thing I can think that might be hurting my rankings.

    If it was affecting my rankings wouldn't there be a message in my webmaster tools or is it just one of those things that the algorithm will just deduct some points and move on without telling me?
