Is A Website Community Property in a Marriage????

    So i have a friend who completely constructed her blog over the last few years (was married for 4) and it literally began to get shared like crazy over social media about 6 months back. Shes doing quite well.

    Her husband is quite the douche. He's only been a guest poster on the blog from time to time.

    Long story short, he was full of immorality and thats why the marriage is ending (if anyone is curious).

    Now that the marriage is ending he's trying to take half of the rev. on the blog. Or is demanding her to sell the blog and get half. She has kids and obviously the bills get paid with the blog. THe husband didn't work or bring in any income.

    I've been scouring the web for laws and haven't found anything (case logs) pertaining to websites and how they are divided up in a divorce. The state is IN.

    I know this is not specific to the forum, but wonder if a website owner here has gone through something similar. Mind you, I've been researching for about a week and posted here as a last resort before contacting an attorney in IN.

    She can transfer ( sell for symbolic price ) the domain and site to a sure friend and officially not owning it until everything is settled.

    So she can sell it before the divorce (we already thought of the idea of me being the purchaser) and the ex couldn't do anything?

    That could be construed as a fraudulent transaction and open a can of worms that would taste mealy at best.

    She really needs to speak with an attorney to see what the State specifics are on this. The blog is probably considered a business entity (mine are), and the lawyers are going to have to get paid to sort that out unless they come to an agreement in the divorce process as to property.

    Yeah, she definitely needs to seek professional legal advice now.
    Don't wait and make sure she doesn't agree anything until she has spoken to a Lawyer.
    Hopefully you aren't being mentioned in the Divorce proceedings OP!

    Haha. Nope nothing like that. Like I said, he was definitely the "immoral" one (putting it very lightly).

    I have advised her to speak to her attorney about her options immediately based on yours and BTBs advice, which was obviously the wisest decision before moving forward with anything else.

    This too. I always LOL at people who think it's horrible for people to have their own savings accounts or some kind of agreement over stuff. Like anyone gets married expecting some bum to cheat on them and leave. Or expecting an argument over a blog. lol And then this happens and all that pre-nup stuff suddenly isn't all that horrible eh?

    I heard in North Carolina you actually have to live apart for a year before you can actually file. Fuck that shit. Don't get married. Be happy. Stupid shit like this happens.

    She's probably fucked though. If they both built it together while they were married... uh oh.

    Well if he has NO income, I don't see him being able to hire an attorney. If I were her I'd get an attorney and tell him that she wants to make the fucktard suffer as much as possible! And hell no to giving him one penny of the site. A good attorney should be able to argue that. She has to support the kids.

    LOL If they built it together during the marriage, if I was a gamblin man with huge balls, I'd throw down some cash that he's getting some of it.

    If he has no income, that would probably look even worse. "Hello judge, I didn't have a job because I was building this business with my wife and we were doing well."

    If they were in California he'd definitely get half. Idk about IN though. I don't see him getting anything unless his name is on the business and he can prove that he actually helped her build that blog over the four years they were married.

    Guest posts don't count. Otherwise every blogger who has guest posted anywhere would be able to sue for part of the revenue of the site they posted on. You posted once on a million dollar blog that has 1000 entries? You get 1/1000 of the revenue. Which is just...stupid.

    Anyway I'm not a lawyer. I know common sense and law don't always agree, but I sincerely hope she did NOT put his name on that business or blog. Keep us posted OP.

    What you get or don't get in a divorce is a direct correlation to how good your lawyer is, and what you ask for! How you split assets in a divorce depends largely on where you live and the laws of your State. If he's unemployed, she may have to support him until he can support himself. A business that's developed during a marriage by one partner is definitely a marital asset and it all goes into one pot that holds all the assets to be divided up in the divorce. He may not be entitled to own part of the business, but he may be entitled to own a part of the value of that business. Get a great lawyer! And good luck!

    People are stupid, I always tell them don't do any shit without a prenup but they don't listen. Love and money should not mix no mater what the bitch says.
