    Hi

As the title states, is it illegal to Copy the Design (not content) of Someones Website? And if yes does it have to be copied exactly to be illegal?

    Thanks

Are you ripping their entire site ie a custom script they have built and then putting your content on it?

From what it sounds, if you're caught then they could sue but I don't know the legalities.

Everything that is custom made has it's copyright, so I guess it would be illegal. I don't know how far could someone go to sue you, but I'm sure it's illegal.

just don't get caught, if he is in the same niche and you are direct competitor then chances are he might view your site and see, but if you are a completely different niche chances are he will never find out. also if you steal his graphics and they come up in google images under same keyword you can be busted.. just stay under the radar if ya know what i mean. if its a big company or someone with lot of money they probably would take legal action but if not it probably wouldnt get very far.. just use your judgement...

also it doesnt feel good to be a cheater, you should use your own imagination or hire someone else to design something better than his instead of stealing. use his site for inspiration to do something better. i would never copy someones design

Yes, of course it's illegal. It is also known as copyright infringement.
The worst case is that you will get sued.

I do believe it is called copyright! Try to take the design and improve it/ change some of the elements that might have copyrights!

I am changing some elements, however it is still noticeable where the design came from

This might sound counter intuitive, but
if the site does not display an obvious copywright,
then you can usually do whatever you want with it.

it is strange how some webmasters do not do this,
thus leaving themselves open to copycats.

Check and see if this is the case OP in your situation.

I hope not all I do is steal people designs, LOL hell I got a folder on my bookmarks titled sites to rip lol
    .

but I dont think it would be illegal, then how do clone sites exist? their like 30 adfly sites out there.

you know, if it is illegal to rip someone site and scripts etc then how does teh clone industry exist legitly?

It's actually fairly illegal. Being a web designer, I despise this. Chances are, if you do this you'll be given a cease and desist. If you deny it, you'll be sued and you will lose.

This is actually still illegal. They recently decided that anything made and put on the internet, despite copyright notices, is indeed property to the owner of it. You can still get in trouble for copying it. For example, take a look at MetaLab Design's website. No copyright. One time Firefox tried ripping their site off and got in a lot of trouble over it, despite the lack of copyright.

are you in the same niche?

Copying a design is not illegal, just use your images and not their images.
