actually no one will know for sure exactly how G works, except their own engineers themselves who wrote the
algorithm, it may not come yet to him, but surely it will soon or later. G hates SEO remember.

My best bet is, they don't really spam enough, are a bit careful. However, after all is said and done, Google will come for them. Better believe that, and them being complacent and comfortable will be double painful!

Just report them if you really must and they will be gone. Google is not yet capable of catching every cheater at school quickly. But if you use your brains, just do what they do and get away with it too.

They could be redirecting domains, cloaking links from shreds etc.
so you can't really tell for sure.
if nothing else it proves that spam is still working.

maybe you should stop building those "useful" links to your site and start spamming the hell out of it :)

How old is the domain??? ... My guess is if its an old one before circa. 2007, G's algo takes it lightly and is forgiving of spammy links and just simply discounts/ignores them (like it used to before disavow tool and negative seo reared its ugly head)... My view is based on the fact that many of the top ranking site which have a domain age of more than say 8 years seem to get away with a link profile that new sites could not possibly attempt to replicate these days... In my mind any attempts will definitely lead to a penalty...
