I just got a cease and decease letter for a domain I own, what now

    Hello everyone, today I checked my buisness email and see I have a cease and decease letter from a internet consulting company representing a company that I am "impersonating", they want me to transfer 3 domains I own to them along with terminate a Youtube channel I own. Do I actually need to do this or can they suck my balls?

    O yeah, a lot. Multiple times and very blatantly.

    So I know I should delete my channel and content on my websites but do I have to give them my domains? Can I charge them for them at all?

    Lol, it's honestly too early in the morning for me to tell whether or not it's sarcasm, but if you are infringing then you're pretty much fucked.

    Otherwise, you don't have to care at all.

    Yeah, if you live in any country where they have legal recourse, the cease and desist is a nice way of saying: "Do what we want voluntarily, or we'll make you do it for us in court."

    All the times I got those kinds of letters, with one exception, I just pulled the sites down didn't respond.

    The one time I did respond it was Google and I gave them the domain.

    I dont think its worth the risk then, my suggestion would be do what they say.

    Alright so ill have to take down my websites I get that, in fact I was just thinking the other day on how I need to switch to a bullet proof host and better my opsec. Anyway do I have to transfer them my domains? Here is exactly what they said in regards to this "confirm, in writing to our attention, your availability to immediately transfer the abovereferenced domain names, free of any charge,"

    I would not even respond.

    I'd take the sites down and ignore them.

    Do I need to transfer them my domains as they demanded or is it enough just to delete the contents on them?

    Right now, everything is voluntary. What you're trying to avoid is the problem escalating.

    Isn't there an ICANN / IANA rule that if the domain was registered prior the trademark you could keep that domain.
    If the domains ar more than less important for your business / earning, I would contact a lawyer and check that.

    Afaik for Germany and denic rules you would in most cases keep the domain and your business.

    While principle is nice, the important detail is if he wants to spend the money to defend that principle. Being "right" can get very expensive in the courts.

    All I do when that happens is to change the name servers - I don't respond nor do I give them anything.

    I've gotten a bunch of those over the years and have never had to do anything more than that for all but the Google one I got.

    I've never had anyone come after me after just changing the NS so they do not show up online any longer.

    My knowledge about the US court system is pretty limited, I only heard about crazy costs. Anyway wouldn't it be easier for a lawyer to seize the domains directly from the according nic and get that yt channel suspended? I mean if that facts check out strong, the rules of mosts nics are pretty clear on those cases.

    So far I've read "suck my balls", "United of States", "Cease and Decease" (Stop and Death???? (not even Die LOL) ) and saw his DP.
