You know those ToS checkboxes that you see all over the internet at the end of submission forms? I've got them on all of my websites that accept submitted info. I have them all pre-checked by default. They can of course, uncheck it. But then the data won't submit. Any idea if thats illegal? I've been doing it this way for quite sometime and have sent well over 100k people through forms with pre-checked "I agree to ToS" boxes. No legal problems yet. However, I'm about to ramp up the traffic to my sites big time (major corporation) and they have concerns about it being prechecked by default.
