I have good reason to believe i am getting negative seo'ed (I wont mention how i know this but i am 100% sure)

other than disavow (which i hear kind of sucks) is there anything i can do to mitigate the effects?

I have the ip address of the individual doing this (again, I wont mention how, but I am 100% sure that's him)
if i file a lawsuit and subpoena his isp, will it get anywhere?

Lol at you filing a lawsuit. Negative SEO isn't illegal. It's only unethical. I advise that you build better links to lessen the ratio of bad to good links in your link profile.

Should be illegal in my opinion, its no different to ruining someones business by going to their shop and burning the place down.

    Good Luck OP

wow, you guys have no fucking clue how the legal system works. who said anything about legal vs. illegal?
if A runs B over in an accident, breaking B's legs, that's not illegal, but A still has to pay for the damages.

Yeah, I would hire an expensive lawyer to get his IP adressed subpoena'd and then try also to convince the judge for a warrant on his laptop or computer and every other device he has. All the evidence that he's NEG seo'ing you MIGHT be there. Once you do that, it's time to go to court. Make sure that you and your expensive lawyer has all the evidence to present to the judge and the jury. You'll probably spend months going back and forth to the court hearing so make sure to hire a guy to update your website once in a while and to also make sure that no new NEG SEO is being done (which again, you can sue, of course).

You also need to prove that what he is doing is malicious with the intent to d damage, and prove the amount of damage. That will be the hardest part with your expensive, specialized internet lawyer, convincing a judge and potential jury of the damage and the amount of monetary damage.

ok, thank you guys, i see where i was wrong. not trying to offend anybody, I just wanted an answer that was logical.
the 2 answers above are more convincing than "oh no, you can't sue, neg seo is not illegal"

The right thing to do is build more high quality links to your site so that the ratio of neg seo links can be lessen. But that's easier said than done.

The more logical way: Disavow all the links he is pointing towards your site, if they are all site-wide. If he's attacking just a couple of pages, redirect his neg links back to his site.

Aside from disavow and pray, at this point in time there is nothing you can do the way the system is set up.

I never experienced this until my websites started to rank well with Google. When the competition has an eye on you this happens. Don't start a war with them because it will be more harm than good.
