They can get it back through a couple means if it's a legitimate trademark (ICANN and ACPA).

You might be able to argue you have an older existing business though, even if it's really small. The people who own QLP.com come to mind. I also had a licensing professor who bought Ralphs.com back in the 90's and got a big settlement because he actually had an uncle named Ralph and went through the effort of making it a page about him.

Hello, why would you want a trademark domain?

I copy paste this for you:

"Congress passed the Anticybersquatting Consumer Protection Act in November 1999 to help companies protect themselves by gaining control over domains that are similar to their name or trademark. In order to receive this protection, however, the company must prove that the domain name in question was registered in bad faith. When there is any doubt, the first commercial use of a trademark owns it in the case of conflict."

This means you would have had to trademarked google before google existed to be able to have claim to their trademark. Much like the uncle Ralph story. The only benefit of a trademark domain is to protect YOUR company from copycats and thieves. There are plenty of companies that will help you trademark your domain names for a fee, buying another companies trademark domain will not get you anywhere, the MAN will likely always take it from you and give it to them.

CANN is the organization that oversees the process of approving domain nameregistrars. Every registrar provides a searching system to determine if a domain name is available. Type in the domain name choice and the registrar will determine if it is available.

Why do you want to buy a trademarked domain? Are you looking for trouble?
