How is this youtube user getting away with this?

Hi,

I've found a Youtube channel that seems to be uploading copyrighted videos on his channel and not only that he's adding affiliate links within his video descriptions. To my knowledge these two things are against Youtube's TOS and i just wondered how he is getting away it? Do you think he is genuinely unaware of what hes doing or is he just risking it until he gets caught?

Am not outing anyone, i was just curious how he was doing it, as i had a similar idea myself!
