I would go with Yes they still can.
You may want to consider a bulletproof domain registrar..... tonic.to for example.

DMCA or not, I would not choose GD. I've had problems with them in the past where I had done nothing wrong.
To give a specific example: I forgot one of the private domain registration passwords. They basically create an private domain account for each domain you hide the whois for. I forgot the password, and they refused to release my domain until I produced that private registration password. I don't remember how I solved it, I think I had to send them a bunch of documents to prove I was not a scammer.... it's been 3+ years without GD and unless they change radically I'm never going back. They simply don't need you as a customer and they make that really clear.
u can make fake whois than paying for private registration
Regardless of the registar if ICANN receive direct complains it will be suspended.
