How do you guys handle DMCA adult image removal reports!

    hello friends,

    My client runs an adult image website
    where most of the images are collected from Internet

    off late he has been receiving some mails through report image mail something like this

    do u guys remove it straight away or ask for some sort of verification because people can make fake claims?

    my query is because the image clearly shows that the model was more than 18 years

    I think you have to ask for verification. Every legit "porn-site" asks for verification in case of DMCA notice.

    what kind of verification he can ask for for a mail like this

    he ask her to show her pic with name of the site written on paper ?
    what kind of verification he shall ask for in this case

    one guy even reported in cloudflare abuse department and then the host contacted my client to take the post down..reason was model was 17 when pic was taken

    but all these seems fishy to me

    Yep, it seems very lame. I think pic with random text is enough for these fishy mails, but i'm not professional.

    I think this is the perfect question to ask a lawyer and not a forum full of people who are going to give you conflicting advice. Promoting images of CP is probably grounds for many years in prison - if it were me I'd take the image down and DOD wipe the hard drives before the alphabet soup takes you away to the worst summer camp ever (and you end up being Jared's cellmate)

    It's better to do it with you lawyer for sure. But if he had one would he ask this here?

    Ask for proof that the person was indeed 17 when picture was taken. Check also the image it self for clues. if it is the original picture you can check the EXIF for date as example. Also do a google images search for the same pic and check other sites etc. There are so many ways to discover if it is a real DMCA complaint or just a fake one. Don't forget to add the DMCA 2259 at the bottom of your page tho :)

    There are shitloads of pr0n pictures online... why does he want to keep exactly these on his page?
    He doesn't have any rights to use the picture anyway, he doesn't have the papers to verify the age of the model in the picture if asked by authorities, he can do one click and forget about it. Why the hassle dealing with this, if I were the girl, I wouldn't submit proof, I'd submit a real DMCA and sue his ass if in the same country, else look for what other ways are possible to get a hold of him.

    Remove, send a friendly email that its removed and move on - I wouldn't spend 5 minutes on that.

    The "I was a minor" is one of the oldest tricks that people do to try to get adult images or videos removed. As for needing permission you most likely don't since a fucking amateur pic doesn't hold copyright status unless its a very artistic and creative pic.

    I guess there is something similar even in the USA, else everyone could advertise with the face of any person they obtained a photograph of...
