BHW survives because:

1. BHW doesn't share the content
2. That section is for users to post free/their own content. Posting downloads that are copyrighted is not encouraged by the forum
3. BHW puts up contact info for the DMCA/is fully DMCA compliant (takes down w/e they are asked to take down)

I don't bother with the downloads section, yet BHW is still a very useful resource. It's also full of people buying and selling tools and services and sharing decent information.

Webmasters are not responsible for the user-generated content on a site. I think they however, to stay clear from trouble, remove any content that get DCMA complaints. It will survive, don't worry.
