Help! this guy wants me to pay him for this photo

    Today I got an email:

    "Message Body:
    I was looking at your website and I noticed that you have a copyrighted image that belongs to me.
    It's called *****.
    You do not have permission to use my image on your site.
    I am writing to you to request that you either remove the image immediately or provide a link to my site: http://www.hiswebsite directly below the image.
    Or you can purchase it for use on http://www.mywebsite site only for $50 (USD).

    That is all but he is my competitor and I won't give him a backlink so easy!
    What would happen if I tell him to screw himself? can he really do something?

    and when you ask me to remove it i tell you to screw your self.

    make sure he is the owner of that photo. pay him or remove the photo.
    its as simple as that.
    he did give you the chance to buy it, and not to backlink his website.

    You have 3 options all of which are bound not to hurt you that much:
    1. Buy the picture
    2. Remove the picture
    3. Give him a nofollow link (I wouldn't suggest it but if you don't want to do the other 2 that is your only real option)

    If you ignore him you may get a lawsuit and that would hurt a lot more (maybe 5000USD maybe more). Just play it safe and you will be fine.

    As said above, check he is the actual owner, if so... remove or buy the pic. Ypu really don't want to mess with copyrighted material.

    Well if this guy owns the rights to the photo you are breaking the law and it's illegal. Black hat doesn't necessarily mean illegal activity, only unethical and unfair and maybe something that doesn't comply with Google's or some other websites TOS. Your question is answered above and if you still want to break the law and risk losing quite big amount of money you are free to do so... Just my 2 cents, no offence

    Edit: Seems like xxxaff was a little faster :)

    Wait... So you stole an image from him and he wants some type of recognition for his own image? If I were you I would comply with his request.

    But if I were that guy, I would have contacted Google and have told them that some dickweed was stealing content from me. LOL

    Please stop with these dumbass posts requesting help when you're in the wrong!!!!!

    Where'd you get the image from? Flickr? You better get that one out and create a new content. Otherwise, lawsuit is on your way.

    I can host that image for you if that helps. There is no way anyone can make me to take it off.

    Preferred option: Just remove the image and move on.

    Other options: Pay him via paypal then do a chargeback. He'll be in the negative.

    Decide which route you want to take.
    You can be evil, you can be ignorant, act as you like.

    btw: he is still wasting your time and bandwidth so maybe:

    fake reply: message could not be delivered
    other reply: you have absolutely no rights to request me to do anything. Provide more proof and I'll remove it .. blah blah. Make him work, keep wasting his time.

    Many many options here...

    I usually just move these to /dev/null , no one hears them scream there :)

    Images are copyrighten unless they're released, which I guess this is not. Pay or take it down, you're violating copyright law if he really owns the pic.

    First you need to make sure he is the rightful owner of the image/photo and has actual copyright on it. Even if he has no official copyright on it, its just a bad business ethic from you.

    You may just remove the image and move on or alter the image significantly.

    But my advise would be hire someone on fiverr for $5 to create new image similar to the one he has. Its just a stupid image man,

    I can not count the number of times I used to loose hostings, domains paypal accounts etc for similar shit like that. It's not worth it! (yes yes that was while ago and I thought I was safe with anonymous domain and offshore hosting but there is always something linking back to you)

    I was in similar situation and was actually sued for $150000 in Cali for copyright infringement, unjust enrichment and what not. It was a live sport broadcasting thing and much much much more valuable than the situation you have. I ended up losing 4 grand on hosting, restreams and countless months I was preparing for the event just get fucking sued and not to mention I neglected all my other projects.
    I say that only to tell you he has options.


    As mentioned above you would not like someone taking your stuff and misusing.

    Trust me fighting over a stupid photo could cost you much more than a photo.

    I agree, take it down - why would you want one of your competitors images anyway? It can't be that hard to source or create your own?

    If you don't want to take it down, throw a bit.ly link down on the page with his anchor text. That's not a backlink but he still gets what he wants.

    It would depend in what country you live. I have seen a few really ugly lawsuits that went to court, where the copyist lost.

    But I have also seen a lot of cases, where a competitor makes a "drama email" but are not the actually owner of the photo (or article).

    I'm not going to give a specific advice, but do consider if the choice you make, is worth the trouble (and time you are going to spend on it).
