woke up toady to find out 1 of my websites has been taken down and hosting account locked.. Yes I was shocked. Checked my email and find the email from my hosting company.. CS-cart.c0m filed a DCMA because they stated my license for the cart was not valid.. I purchased that cart through somebody in the digital point forums and yes I got taken for a ride.. So now I paid full purchase price of the shopping cart website from the company homepage..

Let me add that they are international and are located in Russia

Okay so now that i bought the license my hosting account and website is still off line.

They told me to file a chilling effects counter. So will this all pan out now that i bought the license from them. And how do I find out who is the service provider agent that is need for the counter..

Any thoughts any advice would be helpful:)
 
Well first of all I'd like to know the hosting company you're with TO AVOID IT They need to warn you before taking any actions.

What if I call my competitor's hosting company right in the middle of a PPC campaign and tell them they use a pirated script ?!

Even Godaddy warns you first ...as it happent in my case with a pirated VBulettin script

Try to call the hosting and also tell CS cart to inform the hosting you have now a valid license
 
Yeah its taking care of now i got back online.. The hosting was hostgator(sigh)

Im switching hosting pronto because i told them they should warn me first so i correct the mistake or find it if the claim is false..So it looks like i might be moving to godaddy ..Any advice? Will i lose my rank or links if i switch servers?
 
Godaddy have no cpanel control panel, imo, cpanel is very good control panel. Ask for taking site down, many hosting providers do it, since you have fixed problem at your side, there is no need to switch hosting. If you have a new site, try different hosting and see if they are good for you or you will meet with unexpected problems as software, control panel may be different with godaddy.
 
They should have indeed warned you first, and the fact you bought the script on DP proves that you shouldnt buy any licensed software, without them providing a login/password and the email of the order reciept and verifying it first with the script company/creator.
Learn from your mistakes man, thats the best way.
 
You need to find a new host, that's outrageous. As for how a Russian company can claim DMCA and for that I don't know. If you had cracked their program and distributing it, sure but that's not the case.

Remove the program (always alternatives) and move your business elsewhere.

Do not host with godaddy if you care about your sites.
This will pull your site down wayyy faster then hostdaddy ever did.
 
Now It seems I'm the other side of the wall. :( Some one copied part of my site and use one of my scripts claiming as his own


Question.. DCMA's notices to hosting company and GOOGLE have to be sent in plain text or should I print the form, sign in it and then PDF'it ?!

It has to be signed. Most places won't even read it without receiving a signed copy via fax/postal mail..
 
if it ain't broke don't fix it. It is very wrong they did not check with you before taking you down, if i were you i would find another host for a new domain test it out and then decide whether you want to move the site.

That sort of thing makes me laugh!!! The amount of people that are stupid enough to leave the nulled .nfo file on thier hosting, they just deserve to get caught!! It is one of the easiest ways that companies are checking validity of scripts, yet so many lazy people dont even think about removing it!

As far as I know filing a bogus DMCA take down notice is a criminal offense.
 
there are several large portals that contain reviews about hosting providers.
In your case i'd write a negative review about hostgator, they honestly seem to suck.
