Just got this email earlier today from a .info I registered a little while ago and it does have "walmart" in the title. I'm wondering if I HAVE to take it down now? I just got done investing a bit of time and money into something I was going to try but now thinking i'm just gonna have to drop it.

Yes. You are using their name to sell something. You need permission for that.

Unless you are fraudulently pretending to be walmart, I can't see what the problem is here?

    The problem is trademark infringement.

They own the mark and are protecting it.

He's not infringing upon the trademark, which (I believe) refers to the corporate branding. (Logo, font, slogans etc)

I got one from Yahoo in 2007 3 months after I registered a .com domain with the word "yahoo".
They sent this email to my hosting too. I canceled that domain name after I got the 2nd email, so this domain was parked free by the registrar (GoDaddy)...1 month after I canceled it they requested GoDaddy to redirect the domain to yahoo.com
Now, if you go to that domain, you are redirected to yahoo.com/oops

The mark is the name in all probability in this situation.

Guys, there is no way to register a domain name with any trademarked or registered name without their permission.

If you regged this name recently, I would suggest contact your company-registrar and request so called "domain grace-delete". It is an ICANN policy to allow grace deletes within certain short (like 6 days or so) period after name registration. Usually registrars would honor your request for grace delete, even though they prefer not to advertise this option in public.

Just tell them exactly what happened like "I did not know about trademark law implications related to domain name that I've picked blah blah".

Sure .INFO is just a dollar or two, but you would probably feel better about it. Just learn this lesson and move on. Many other people learned it the same way.

Not true, they don't need to contact you or your host that is just the simplest approach for them since people usually stop after getting an e-mail. They can go to ICANN which is US based and get the domain transfered to them.

Bottom line, if you use a company's trademarked name in your domain name they can take your domain.

I think if the name is not an actual word it can be protected completely. If it is an actual word, others can use it if the usage has nothing to do with the owner's business. I guess anyone can register apple.sex or windows.sex (lol) but not walmart.tld

I guess 'yahoo' is disputable as it is an actual real-world exclamation as well. Also ICANN prefers not to interfere, most lawyers seem to get court orders instead.

ICANN also generally does not regulate ownership under international TLDs, that is why MS, G and many others rush to register their new trademarks under every thinkable tld before announcing the product.
