Got an idea for CPA site, but what i need is some advice of its legality.

I have made a site that "contains" an online version of some popular application. It loads like real application with loading screen. When it finishes loading this application appears and looks exactly like original. But at the same time CPA popup appears asking for visitor to complete one of their surveys for accessing this fake online version of application. After completing survey, only active button will be disclaimer (added by me). It will say something like this -we provide a brief overview of this application only. We do not host this application or any other applications of its developers. So apparently this site is useless, but of course youtube comments and videos (which will make my traffic) will say something else.

Everything seems to be simple, but i have some questions about copyrights and stuff like that.

    1. Could there be any consequences for doing this? I mean there is lots of sites containing videos and photos of this application. Only my page consists of this applications picture only (it has been cut in peaces and used as background pictures, making it act like real app when browser is being stretched). And of course, as picture of application it contains applications logo.

    2. Can I fake original loading screen? Original loading screen contains applications logo and names of developers. So that my page doesn't contain this application, i guess i shouldn't say it's loading. Or should I, "for giving visitor more realistic feeling" of this application? For once again, it will be just an image of application.

    3. I' m convinced that i can't use logo of this application for site icon, but if change it a little?

The look can feel of an application is protected by copyright. If the onwer of the application bothered to register the copyright you would face statutary damages in a civil suit - I forget the exact amount, but it's tens of thousands of dollars. If they really wanted to nail you, copyright infringement is also a criminal offence, but that is usually reserved for people pirating thousands of popular warez or DVDz. In practice the most likely thing they would do would be to send you a letter from their lawyer telling you to stop doing that, and if you did they would not go after you any more.

Do not ignore the letter from the lawer however, or you could be in deep sh*t.

This couldn't possibly damage their business. There would even be link to their downloads directory! :D

And what about other sites containing pictures and videos of this app? isn't this the same, just with bigger picture?
