I have a website that has some shady backlinks and it is penalized by Google. I want to move this website to a new domain and redirect the old domain to the new one. However, I'm afraid that if I redirect the penalized domain to the new one, the shady backlinks will be redirected too (won't they?) and because of this my new domain would get penalized as well. Am I right?

What would you advise me to do?

You will pass the penalty to the new site with 301

Save the content, delete the old site, check the content does not have copies online (100% unique) by copying and pasting some of the text to G search and checking with copyscape, then repost the content to your new site but DO NOT forward the ld domain to the new domain. Jiust start again with new better quality links.

If you do direct the old site to the new site you will get penalised again yes. I would start from fresh and try and remove anything that would get you penalised again by Google. Redirecting will only land you in the same boat.

you could try to redirect to a buffer site or bitly link that would absorb the penalty and pass link juice
