Fired from my job today - This is funny!

    So, I have been working at this tobacco shop for a while now. I started working there initially because I owned a very small percentage, but eventually I just let the owner buy me out = Less headache. Anyways, I was working there 7 days a week 16 hours a day and making only $400 a week. I make twice that in the little time I'm online lol. Anyways, I got tired of all the hours, so I asked for 2 nights off each week. Last week he started giving me 3 days off instead of the 2 I asked for. Well on the third day, he was tired of running the store all night so he called me and said he needed to take his daughter to the hospital. And even though a few months ago when my daughter was in the hospital he said he would fire me if I didnt get my wife to stay with her and I go to work, I said I would be a bigger man and still go in so he could take his daughter to the hospital. Then the next night, I said can I have tonight off since I came in for you, and he said "what? you don't want your job or what?" I said ok, I see :D So monday came around and it was my first night off of the next week, and right at the time I usually went to work he starts calling and texting me off the hook. I didn't answer. Then later my friend went up there and asked him where I was. He told my friend that he fired me. So then today I was at my friends house, and I was like damn. Since I get paid cash, I'm gonna have to get him to somehow openly admit that I worked for him and he fired me on my day off. I was gonna take my phone up there and without him knowing, I was gonna record the conversation with him telling me that I was fired. Then the perfect thing happened! He actually sent me a text message saying that I was fired from "Company name here" And that my friends is all I need. I have a text message from the owners phone, on my day off, saying that I am fired. And I have a letter from his wife to the car lot stating how much I make each week and how long I have been there. Now of course he will try to tell unemployment that I did not work there, and when he does, it will make anything he says from there on uncredible :).


    EDIT: To make the situation better for me, I had sent him a text earlier asking what I had done to get fired from my job on my day off, and he just now replied. His reply was this: "Nothing, we just had a chance to think about what is best for the company on your day off." :D Perfect! Unemployment here I come = Free money :D

    But honestly since you weren't paying taxes, I don't think you should take unemployment.

    ...unless you have paid before, then go for it!..

    Quick question: If you make twice that amount online, why work there? Is it just for the off the books cash (i think that's how you're getting paid)? If so, you aren't going to get unemployment because you weren't officially employed by him (no tax records).

    Depending on what state you live in, recording a conversation without both parties being aware of it could be a felony, biting you right in the ass if you tried to act on it.

    To respond to both of these, I do need it. Yes I make twice that online, but when you factor in a wife, 8 kids, and one on the way, then you can see why. Also, just to let you know. I will not be getting over on the state of texas. In texas, if you work for a company and they do not pay unemployment taxes (which he doesn't) then that company is forced by the state to compensate you directly through them otherwise be shut down. So really he will be paying for a huge mistake he made firing someone because they wouldn't come in on their day off :D


    Also, tax records are out the window. No need. He already admitted in text that I worked there, so he can't say I didn't :D

    It's on the phone company's records anyway. They can just pull up the text whenever they need to.

    Sorry to hear about your job. I recently found out that I'm getting laid off from my full time job on November 30th. I'm looking forward to unemployment, but I don't know if it will pay enough to afford all my bills. I have an interview for a new job next week so hopefully I will get that job.

    It sucks losing a job but unemployment is nice! Sit on your ass and get paid. I also see it as an opportunity to spend more time on IM since a lot of the time I'm too tired to do anything after I get home from work.

    Unemployment money != free money. It doesnt grow on trees or spring from a crack in the ground, it comes from tax payers.

    Maybe you can negotiate with him for that percentage you sold back to him. Might be worth more in the long run...

    Here in AZ, the most you can get in Unemployment is ~$1000/month, you may be able to have him put you back on as a partner that has a lower value, but over time will make you more...

    Having his records go into court could really mess the dude's biz up, I know I wouldn't want any employees talking about our taxes. That's why we have them as interns, and give them "weekly bonuses"...

    This is partially true. In texas, we don't pay state taxes. Employers pay unemployment taxes. But either way, in my particular situation, it would be only the employer who fired me that would be responsible for paying it.


    Furthermore, the guy is a complete asshole. If you knew how much this dude has put me through, you would understand much more. His customers don't even like him because he talks down to them. Yet they still send money there. Kinda reminds me of a method lol

    You say you "have" to work a 16 hour a day job because you have a wife and 8 kids... Yet you have another one on the way? Good idea...bad idea...Planned or not, birth control or not, I would be wearing a chastity belt. Also, I feel that if you receive unemployment benefits from under the table wages, then you should also pay taxes on the income as well. Plus, it's not like the unemployment money you are getting is literally all from him paying, it's a federal tax. Employers only pay 1 - 2.7% of what they pay employees into unemployment. Also, him paying you under the table is actually illegal and can lead to fines or even imprisonment, it's considered intentional avoidance of employment taxes which in a way is tax evasion and fraud. For you it's a form of income tax evasion and fraud, but it's not like you were making a lot, so who knows. I would really look into it first before you tell them you were intentionally getting paid under the table, cause to them they just see both of you committing tax evasion.

    He could also 1099 you, and then you have to pay everything he has accounted for.

    So, unless he's a terrible bookkeeper, you will probably have to pay taxes on all of your unclaimed wages as well as your unemployment pay...

    True, but I know texas law very well. Actually I have already been through this before. And I do pay taxes. He pays me weekly, I pay taxes quarterly. And with the kids. Planned no, birth control yes. Didn't work. She was on the pill and still got pregnant. But just to clear things up a little, I am not one of those people who enjoys free money. Actually I prefer to work. Not my fault an ashole fired me for no reason. And he will be soley responsible in the state of texas and he will have to pay what is owed.

    sorry to hear you lost your job and I hope you can somehow work it out. I have 3 kids, crazy {literally} soon to be ex wife and bills thru the roof, so I know how thought things can be.

    However, I started working on payroll and paying my taxes less than 1 month after I immigrated to USA, this is many years ago now. I even paid the airplane ticket back to IRC. But of course I came with loads of money from Germany. Years came and passed and I had years where I paid $30K/year in taxes. Mostly from my online earnings.

    I also had a day job in manufacturing making like $35K/year, just to pay into social security and get my points. However I was laid off in '08. I very reluctantly applied for unemployment and was getting the almost max in Calif of $440/week. It might sound like lot considering you actually worked for that much, but I am in the bay area and I still had to pay taxes even on the unemployment.
    After few months I stopped my UE claim, even though I had paid in so much more that=n I received back, but I felt I was young, smart and able to support my family without the gov and others needed it more.

    I certainly do not want to get into politics here but I lived in very successful socialist country {before dickheads decided to blow it up} which was not really evil as you were thought, and very prosperous and successful capitalist system with social responsibility and safety net, and now the USA with, whatever.

    My position is devided, on one hand I feel your pain but at the same time I am not sure its best course to seek unemployment considering you have not paid into the system. Additionally what about the $800/week from IM, do yo pay taxes on that?

    I am sorry if I sound mean, but don't go down that path. Yo can do better. If you need stability try to get a IM job.

    It's a PITA to be kicked-out of a job if (IF) just because your boss simply felt like kicking you out without valid reasons.

    IMO, get that swollen head down to lick his own ass for being a assh0l3 to a good employee and the employee's family. Before you do that, get proper legal advice though. Such dictators who are utterly selfish should always be hooked out of their waters. Hope you get proper justice.

    Even if you have a second or a third earning, that is of no concern here and everyone is entitled to earn as much in such hard times.
