Facebook is suing a NameCheap for selling deceptive web addresses

Facebook is suing Arizona domain name registrar Namecheap and its proxy service Whoisguard for allowing people to register domain names that “deceive people by pretending to be affiliated with Facebook apps,”

Whoisguard registered 45 domain names — including instagrambusinesshelp.com, facebo0k-login.com, and whatsappdownload.site — that infringe on Facebook’s trademarks, according to the post by Christen Dubois, Facebook’s director and associate general counsel of IP litigation.

“Outside of said protocol, a legal court order is always required to provide private user information,” Musso says. “Facebook may be willing to tread all over their customers’ privacy on their own platform, and in this case it appears they want other companies to do it for them, with their own customers. This is just another attack on privacy and due process in order to strong arm companies that have services like WhoisGuard, intended to protect millions of Internet users’ privacy.”

Now that's a bold statement to make.

Missed the point that the domains are all copyright infringing so the names will be list either way, I'd assume it's obviously about getting the user data to sue them. Will be interesting to see if the domain registrar can be held accountable if they do not provide the user info, so they would need to pay up instead.

Shoutout to NameCheap for trying to protect their users privacy.

I don't agree with what the scammers are using the domains for of course but there are processes to deal with those issues that don't involve everyone having to give up their right to privacy.

This is a classic Facebook move :alien:

One can sue anybody in the USA.

This is a scare tactic by Facebook; legally they cannot hold Namecheap responsible for the actions of others who use their platform, even if it is for nefarious reasons... anymore than people can hold Facebook legally responsible for flase advertisements that Facebook allows on their platform. The hypocrisy of Facebook would be hilarious if it wasn't so egregious.

They are too old in this field to get scared from this stuff even if it comes from a giant like facebook. There were some others who tried something similar in the past but against Cloudflare and they didn't win anything :)
Just a waste of money and time.

You are correct Nubian Content, but not on Namecheap's part.

I own a number of domain names that are egregious cases of trademark infringment; yes, the registrars can be sued, but the companies that hold those trademarks will lose.

    They have to SUE me!

Correction, they can't sue me, they have to SUE the LLC's that I setup to purchase those domain names.

If they come after any of those LLC's they will magically go POOF in the bankruptcy courts.

I rolled the dice knowing what I was getting into and was prepared for the risks because of the rewards.

So far, 5 years and counting and not a peep from any trademark attorneys.

Or course, I'm running websites that compliments their brands, so maybe they let me pass?

It's just like pirated content being uploaded to Facebook?
How can Facebook say NameCheap is responsible for copyright infringement and not be held accountable for all the infringed content uploaded to Facebook?

If FB thinks that Namecheap is responsible, then FB should be sued daily because everyday, people are running blackhat/phishing and many other illegal campaigns on FB
