    Ive heard google spiders can detect duplicate templates and drop the ranking of sites based on it...
    what parts of the template should i modify to avoid such issues?

    footer? first thing the comes to mind, I never heard of this but I would chance all the links and text in the theme

    It is not advisable to use cracked templates because people may have not taken the track back codes off properly. Once those are off, it is fine to use.

    There are no negative effects on SEO. Trust me, I know from experience.
