Two eBay sellers selling the exact same product. #1 is 40 cents cheaper than #2, is based in Wisconsin and is charging @ $1.21 in "Texas Sales Tax".

We Texans hate taxes. AND cheddar heads.

eBay seller #2 is 40 cents more, but NO sales tax.

    WTF?

How is one seller charging Sales Tax and another is not. Is the 1st one running a scam? Is the 2nd one going to prison?

I've superficially read about people complaining about having to charge and pay sales tax for e-commerce, but didn't care enough to pay attention until now.

Yeah, eCommerce tax is weird. For a while, the responsibility of paying taxes on goods purchased online actually fell on the consumer, who was supposed to apply their state's tax to any purchased online goods come tax time (not like anyone did...), but now there has been movement from a few states (and maybe even at the federal level) to force the seller to apply taxes prior to sale, which is still tricky because small, independent sellers can easily get away with not reporting such small taxes.

So, believe it or not, seller #1 and #2 might be perfectly fine and entitled to their set pricing. There is so much ambiguity (especially with smaller sellers) that the only way to be sure is to seek proper tax counsel from a professional in your state.

Thanks for the reply. I bought from Seller #2 in order to make a statement.

40c is a small price to pay for your breast health.

Huh? Vitamin D3 is not for breasts, is it? Does it make them bigger, like Viagra?

In this case, the seller was in Wisconsin, on the other side of the country.

I know that when I was doing arbitrage (dropshipping from amazon to ebay), I had to charge sales tax for some states because amazon charged sales tax for a few states and I passed the cost on to the buyer on ebay....but that was the only time I charged sales tax on ebay

You can be the most affordable supplier in all of eBay, but if you don't know how to successfully record your products or services or service then it does not matter. It really is impressive how many suppliers on eBay don't know how to do this properly...thanks
