ebay feedback extortions are already starting...

The legal definition of slander is: A type of defamation. Slander is an untruthful oral (spoken) statement about a person that harms the person's reputation or standing in the community. Because slander is a tort (a civil wrong), the injured person can bring a lawsuit against the person who made the false statement. If the statement is made via broadcast media -- for example, over the radio or on TV -- it is considered libel, rather than slander, because the statement has the potential to reach a very wide audience.

So in actual fact, as negative feedback is written it is libel not slander. Secondly, it is business. The negative feedback should be about shoddy goods, or goods not arriving etc., not about a written attack on the seller in person. If I attack the seller personally, it is libellous as I am potentially ruining his reputation in the community.

However;

It is not eBay who is attacking me and being libellous.
The attack is coming to your eBay trading name, not your real name so I don't think it could be argued in court even though it is damaging to your eBay name and reputation. If I had a few thousand dollars to waste, I would like to see it argued in Court, although I'm sure eBay's legal counsel have already thought of this and have it covered.

So how would one bring a lawsuit against someone when you only have their eBay trading name? eBay wouldn't release the traders details. It could not be brought against eBay, as they did not write the negative feedback.

Finally, even if you could find out exactly who the person was, the chances of him being under the same jurisdiction as you are pretty slim.

I am British living in Thailand. I'd like to see anyone from the U.S. taking me to Court over anything. The Thai legal system would not be interested and would simply ignore the U.S., unless it was for a very serious crime like murder, child mollestation or International fraud on a scale like Nick Leeson and Barings Bank.

Are you sure they will take care of it? I wouldn't bet on it. Years ago I received some death threats from a competitor on egay. I fowarded the emails with headers to them. Their response....sorry we can't do anything about that. The only thing they care about is their bottom line, screw everyone else.

I get way more than my fees back so I'm not complaining.

I haven't had anyone blackmail me yet, but if they don't I will tell them to go f*ck themselves. A few negs out of thousands doesn't hurt me.

these buyers are a bunch of whiny bitches ...
if this becomes a big factor someone will create a database/site for the sellers listing these guys...if i ever had someone blackmail me i would put that buyer on my favorite buyers list get alerts when/if they ever list something for sale and give them a dose of their own medicine.

I'd just forward the mail in to ebays abuse department and tell the buyer to piss off. I really think that this was one of the stupidest things ebay could have done, and coupled with the current EPN bannings for no reason I'd bet they will really start to see a difference in their bottom line.

Has anyone tried any of the other auction sites yet?

I completely agree, I am going to court next week because some jerk did not like my neg of him 2 years ago. My argument was just what was posted in quote above. he sued me and ebay. ebay settled, my turn is next week

Hi there, newbie here...

what sucks is that the dark side (ebay) has the monopoly on the auctions sites...there are others but one doesn't sell diddly squat on those.

i went to onlineauction.com and listed items there. i sold two in 5 months or so. people don't want to pay for anything. they basically want a tanzanite ring for $10 if you ask for more...well...you're doomed.

i also went with ebid.net and i was with them for also about 5 months. not one sale. hundreds of watchers but not one buyer.

the fees for both sites are very inexpensive but what good does this do when nobody buys from there ? they all go to ebay and spend their money there.

what other auction sites are out there that draws as much or at least close to the customers as ebay does ?
any idea ? if yes, PLEASE let me know because i HATE ebay but seem to have no other options.

ebay slams sellers with fees, with limitations and we can't leave negative feedback for loser buyers. we simply are asked to lie down and take the beating.

SUGGESTIONS ANYONE for other auction sites ?
