eBay Buyer Steals My Xbox, eBay Sided With Him, What Should I Do??

    On the 30th of January, I sold an Xbox One system with the power brick, two controllers, and three games. The buyer pays the 330$ and I ship it out the next day with Priority-Mail 2 Day with tracking and insurance. He receives the system on the 3rd. The first thing he complains about is the cost of shipping that I actually paid. In the listing, I charged 30$ for shipping, but I paid 15$ for the label. I told him that I would reimburse him the other 15$ that wasn't spent on shipping when I get back from my part time job. He responds in minutes thanking me. Then, about two and a half hours later, he messages me this "So we have another problem I bought this because it stated that it was a 1TB system and not a 500GB what are you going to do about this" As soon as I saw this message, I knew I was going to be in a world of nonsense very soon. I figured that I was going to win whatever stuff he was gonna start because I have the box and original receipts to go with the Xbox One proving that it was the system that I sold. He asks for a partial refund and of course I tell him no. He opens a return (I unknowingly had auto-returns on, didn't even know that was a thing) He then uploads return tracking the next day. Then, about a week and a half passes, nothing shows up in the mail. I check the tracking and all it says is the item departed his town. He then escalates the case with eBay and within an hour, they side with him. I call eBay to appeal this. I ask them why they sided with the buyer. The representative noticed something odd and told me that he used two different tracking numbers, and he told me that he thought the buyer was trying to scam me. He then told me that I would get my money back and the negative feedback that the buyer left me would get deleted. I was so happy to hear this. Then, after five days of winning the appeal "or so I thought" I look on my eBay and I see that the case is still open. I call eBay to ask about the status of my appeal. The representative tells me that my appeal will not be granted because the return address I provided was fake. I asked the rep why she thought that and she gave me a completely different tracking number then that what was listed in the return case, and she tells me "See where it says, no such number? that is why we awarded the buyer a refund, because the return address you provided wasn't valid" They didn't even check my eBay to see that he wrote the address down wrong, because that's what happened. I know my return address on my account is wrote down perfectly. I ask them to reopen the return and they tell me that there is nothing that they can do because the case has already been closed. Long story short, some asshole has my Xbox and my money. I called PayPal an attempt to dispute this decision and they told me that they can't do anything. I am looking for advice on what to do. I don't want this guy to walk away with my 330$

    Wait to sign onto the class action ebay lawsuit when it happens.
    Total bullshit...sorry about your luck man.

    Take a ruler and place it on the sentence that is under the current sentence that you are reading. Then, when you're done reading that sentence, move the ruler down a little till the next sentence is visible. Repeat until you've read the entire post. Hope this helped

    eBay lost to a class action lawsuit over taking down BIN auctions and still making the sellers pay fees. Back in Oct 2015. Those guys are shady. Never buying or selling on eBay ever again. There are too many better alternatives (primarily for me, Amazon)

    You can appeal cases that are already closed, usually there is a link within the closed case to do so, if not check within the return itself.

    If you cannot find it, you are going to have to wade through the sea of eBay representatives until you get one that will actually take the time to help you. Some reps will tell you that you cannot appeal a case, but in fact you have up to 60 or 75 days after it was closed in the buyer's favor to do so. The appeal is specifically there in case a buyer files a case against you and the package is ultimately delivered, but it also applies in this case as well.

    Don't feel like taking a ride to PA over some Xbox. I'd rather force the money out of his PayPal, ya know?

    I will try to get them to re open the return so that the idiot can hopefully write my address down correct this time.

    I agree with the above, keep trying until you get another rep that's open to your plea. Also I'd personally report the buyer so no other buyers lose money to him.
    That's why I don't sell large items on ebay, too many scammers there. Also, doesn't hurt to check the buyer profiles every once in awhile.
    Also in buyer policies in your back-office on ebay, you can forbid people who have been reported on ebay every 6 months or so.
    Also if you are interested in getting him back, put his email and phone number in an insurance quote site like insureme, he will be getting phone calls FOREVER!
    Or you could sign onto one of these revenge sites.

    I got my money back and the negative feedback was deleted off my account.
