Does this constitute spam?

    I have never really cared in the past because I have never done anything really absolutely illegal. I didnt even care less with the cookies i stuffed years ago. But i have never done any non-opt in emailing (pretty much the only thing I know is 100% illegal to do....)

    But i was just wondering if anyone knew the legality / issues with forum PM spam???

    I was reading the clickbank privacy policy thingo and this is in it

    "If You send, or cause to be sent, any messages or communications by electronic means, including but not limited to email and instant messages ("Emails") in connection with the direct or indirect Promotion or sale of any Product and/or Your use of the ClickBank Services, then You agree, acknowledge, represent and warrant that all such Emails shall be in full-compliance with all applicable federal and state laws and regulations regarding the use of electronic messages,"

    And since PMing is pretty much emailing someone (75% of forums have default that pms get sent to email)

    The only reason I ask is it sounds on the shady side to me and If anyone knew whether it is or isnt cos it would determine how much I need to cover my ass ;)

    i'm pretty sure PMs are not subject to spam laws. the forum sends out the emails, not you.
    and since they opted in to receiving emails from the forum, they basically also opted in to receiving emails from anyone that PMs them.

    clickbank might still ban your ass though, depending on just how you're doing it and how much you do it.

    yeh if its just clickbank thats fine... if it makes me a few easy grand before it gets reported i couldnt care less lol.

    but yeh i was thinking the same thing in regards to it being the forum sending the email and i was merely spamming the forum itself which isn't illegal.

    clickbank should 'ask' me to stop first anyway since it isnt breaking any laws and if they just ban me then, after reading their banning policy, i could sue them for my money as i havent done anything illegal ;)

    i mean... i wouldnt be forcing the person to buy the shit at gunpoint... merely 'recommending' they do :)

    CB gives 2 or 3 warnings before banning account . Although i wouldn't recommend to spam CB offer , as CB is a great network and you may find it usefull in future for legal capaigns
