One of my clients had his homepage removed after falling prey to a DMCA. A few of his other pages are still ranking, albeit lower, for his keywords. (It seems their designer used a copyrighted image.) Anyway, using the search:xyz . com function, there are no results for their homepage. However, if you type in the homepage url, it still appears. And at the bottom of the search page, it says:

In response to a complaint we received under the US Digital Millennium Copyright Act, we have removed 1 result(s) from this page. If you wish, you may read the DMCA complaint that caused the removal(s) at ChillingEffects.org.

My question is, what, if anything, can be done to retrieve his homepage? Does he need to just start a new site? Is doing further seo a waste of time? I am really not sure what to tell him, or even how I could help him out, so if anyone has experience with this, please share. This is a good warning to bhw members to check their own sites so that this kind of thing doesn't happen to them.

You can respond to a dmca stating the action that you've taken(in the notice they recieved), if i remember rightly, not had one for ages. But that option was there for me. Usually you can contact the person who submitted it, and confirm you fixed the problem. Thats what i done, and i can't remember that it done anything bad to my rankings.

My routine was pull image from site and pull site from archive (archive will want to USPS ownership proof).
The image company kept sending 6 or 800 dollar fee/penalty/law suite...

When I finally got tired (un-lazy) of the scare letters I got serious and started process of filing suite for photo coping my trademark and copyrighted home page. Whatever they quit.

Not to make excuses but the image company scraped from an image I pulled from site proly 4yrs prior. They scraped archive

Sounds like you you didn't get take down request so they went straight to G. I believe it's ok to settle up with G when the image is down.

So the option is to counter-claim and say 'hey, we took it down, now please restore our page'?

So, just to be clear, it is possible to get the home page back, but only if g is satisfied that the infringement is gone?
