DMCA - 301 - Will it work?

    Hello fellow BHW's,
    I have a bit of an issue and guessed someone would have faced this before and would therefore know the answer.

    I have a site that's been taken out of the results - it isn't actually a DMCA per se, but rather it's been removed due to a "cease and desist / legal claim" submitted to big G.

    What would happen if the site was recreated on a new domain, and the old site 301'd to it?

    Would the new site rank, or does the removal from results act as a kind of penalty that would carry over?

    Has anyone tried this before, and if so what was the outcome?

    It is difficult to say clearly.
    I tested two domains, one recovered, the other does not.
    Therefore, it is worth checking out.
