Recently I bought a domain only to find out after purchasing that someone has the exact same domain except they have a dash. For example I bought:

    bigredshoes.com

and then found out someone had big-redshoes.com and Big Red Shoes is there business name. They are in the same niche I want to get into as well. Did I just waste my money? I figure if I do anything with the domain I bought I'll get sued by that other company. Any help for this newb?

You can't block anyone to buy similar domain (like bigred-shoes or similarities after point). This business is your own ?

But can I title my website Big Red Shoes and brand around that or do I have to brand around another name but keep the domain?

If you think of a domain like that, the first thing you do when you want to get into the domain is type it in the URL bar without the dash. I would say that you actually have the upper hand.

Why on earth do you think this is a problem? Only trademarked terms cause a problem. I'm not even gonna search because I know big red shoes can't be a trademark (dictionary words). You're good. If anything, the other guy might be interested in buying your domain name.

Is the "brand" name trademarked or something?

Sell the domain to them for a hefty price. :p

Search term + trademark. If it's trademarked, it will come up on justia.com. If not, you're good. As simple as that.

If it is a big brand, how about trading your domain with a good price tag. If they are just some affiliate website and no real brand, then you can go ahead with your domain anyway

I don't see any trouble here. Just go ahead. I had exactly the same case as you and seriously it's not good or bad.

This is not a problem. There is always someone who have similar domain names. You can't stop anyone from buying it or can't buy every possible variation of domain name.

Sites with dashes look scammy as hell. I wonder why the other guy opted for that one instead.

Yeah just consider it as a loss. Trademarked or not, there's already someone with a similar name and it could cause confusion.

If it's not trademarked and you're confident in your marketing skills, go for it.
