CORTEZ, Colo. - Authorities say a 12-year-old Colorado boy accidentally shot himself in the leg while playing with a loaded pistol his parents had hidden behind the family Christmas tree.

Montezuma County Sheriff Gerald Wallace says the boy was shot in the calf on Monday morning but the injury wasn't serious.

Wallace says the parents had left for work but other family members took the boy to a hospital.

The sheriff says he won't recommend charges because the parents had left the .22 pistol a reasonable distance from the child.

It wasn't clear why the weapon was hidden there. Wallace says the boy was "digging around" when he found it. His father had other weapons locked in a safe.

If it was truly left "a reasonable distance from the child" would he have shot himself?"

PS. Are there no laws there that state a gun must be stored empty, with a trigger lock and in a locked case?

meh, now what good is a gun for protection if its' clip/chamber are empty, it has a trigger lock, and its locked away? are you going to ask somebody who has broken into your house to give you a moment while you prepare your weapon?

if parents actually did their jobs, we wouldn't have a need for so many silly laws.

What happened to defending yourself with a baseball bat while someone calls the police?

Do robbers generally carry guns? Usually a large dog scares most people away.

Well a football player sean taylor took that route (though he had a machete instead of a bat) and he was shot and killed by the robber who had a gun.

A dog can scare a robber away. Though it is probably because a dog is like a alarm alerting everyone...but even dogs have to sleep and there is no guarantee the robber is not insane.
