Just signed up here. Banned months ago, trying to take legal action. What are you all doing to get your unpaid earnings back?

Hello,

I realize this is an old thread but I'd just like to contribute my experience with them.

I too was banned with nearly 6k in my account. They banned because they said their advertisers complained about my traffic. They never gave me a real reason other than that. I called and didn't get an answer (as always) they have terrible customer service via phone. I did get one of them to reply to an email about the situation and they forwarded it to the security guy, which only took them a week to do.

After nearly another week passes of me sending an email / AIM conversation once every other day, the security finally contacted me via AIM. The entire time we talked he was just telling me that my traffic wasn't putting in honest information into the offers. After explaining to him where my traffic is from, and that it's all legit. He sees that I had actually not broken any rules. Yet, he shows me in their ToA that I am actually responsible for the traffic I send to them, and that traffics actions.

This really blew my mind, as I only drive legit traffic and have no power over what they do at all. To make a two hour conversation short, I never mentioned money... not a single time did I mention my 6k. I only mentioned how my business is getting destroyed, my reputation etc etc. Eventually he told me I could sign back up with a different account and promote with a different method / business. He also released all funds to my account.

I haven't been to their site since. This was almost a pretty bad deal for me as it was 10 days until Christmas and I was counting on that money they almost stole.

Ducky

I had the same situation except with a substantially larger amount. I decided to switch to another cpa company, and while their payouts aren't quite as high I can relax because they are much more trustworthy.

Best Trustworthy company is leadbolt without a doubt. I don't know about any other trustworthy cpa network though. I wish I did but yeah, they scam my 80 dollars. It was just 80 so I don't really care as much, and yes I followed every single rule of theirs.

I think everyone should throw $100.00 in a pot hire a attorney and file a lawsuit, sometimes u just gotta make 1 company the example so know one else thinks it's ok to play with peoples money.

In CPA lead's ToS it states they can cancel you whenever they want, upon signing up you agreed to that so a lawsuit will just waste time and money for everyone.

1.2. Membership. Your membership in *******'s Affiliate Program will commence on the date your application to join the Affiliate Program is submitted to *******, and will continue unless terminated by one of us. Membership is limited to the specific URL(s) provided by you to ******* in the Account Registration section of the ******* web site. Please note that ******* reserves the right to terminate an existing membership in its sole discretion, for any reason or for no reason at all

Not really, a TOS still has to follow state law. For example you can't write a TOS that goes against state statutes you still have to follow laws, which is one of the reason paypal was sued years ago, and lost...don't think because a company has TOS they can do whatever they want, that's not so. The purpose of a good attorney is to find which laws there breaking in there TOS.

STATUTE
A law established by an act of the legislature.

Under the U.S. and state constitutions, statutes are considered the primary source of law in the U.S. -- that is, legislatures make the law (statutes) and courts interpret the law (cases).

Then what happens, a attorney goes into older cases relevant to yours and see what the judge ruling on those cases were then, and use those cases as support to rule in his/hers clients favor

Example:

The Nevada Fair Employment Practices Act prohibits public and private employers from printing or circulating any notice or advertisement indicating any preference, limitation, specification, or discrimination based on race, color, religion, sex, sexual orientation, age, disability, or national origin. However, such a preference, specification, limitation, or discrimination may be expressed when religion, sex, sexual orientation, age, physical, mental or visual condition, or national origin is a bona fide occupational qualification (BFOQ) for employment. The law applies to employers with 15 or more employees (NV Rev. Stat. Sec. 613.340).

So no company could write a TOS that violates this Navada statue code (NV Rev. Stat. Sec. 613.340).
