I recently found a authority website in my niche which switched to a new design ,which uses a lot of ajax and JavaScript to display content
and it seems a lot of content(75%) is not getting indexed on google due to their faulty design

For testing purposes i scraped a particular page , and pasted it to a blogspot . It showed only 1 copyscape result , 85% unique on smallseotools.com/plagiarism-checker .

Currently I am scraping brute force and have got over 40,000 words .
So my question is can I use this content either on my website or tiers ?

If i manage to get content on my website/tiers Indexed first and later they change their design and everything gets indexed on their website WILL i still be penalized for duplicate content(They have authority) ? I am not scared Dmca etc

Tough I have decided to use the content , I just wanted a second opinion .

I agree with the others that you still want to re-write this content. It seems like a lot of work to put in only to have them DMCA every single page of your site once they realize you've done this. It would be silly to think they won't find their content, and/or that they won't have recourse. Just spend some dimes, and get this stuff re-written to protect your ass and your potential earnings.

I believe design is not the main reason for their content not being indexed.

Official google info from last year:

Yes I know . googlebot can click on those javascript:void(0) buttons and other JS
But When i queried Individual Ajax requests ( using firebug) , I got only that content which is already visible to bot . Also , i should be able to see content on google using "" ???

Write fresh and unique content for your website. Do not copy the content. Your site will never get rankings if your content is copied form other sources. The major search engine focus on creating the best possible user experience. So, the sites which offer relevant information will gain more visibility. Investing in creating original content is the must need of current SEO.

Depends on your purpose, but if it's a long term project then fresh content or at least re-written content is the place to put your effort.

I think you should simply re-modify the contents before using them.
