Competitor deindexed, would it be possible to pillage his content?

If one of my competitors had the misfortune of being deindexed/sandboxed in the recent algorithm updates, would it be an ill-advised move to take paragraphs/excerpts of his EXCEPTIONALLY high quality articles for my own site without being flagged by panda for duplicate content?
 
Why not try using a content spinner, such as WordAi, to get a quality spin on the content whilst avoiding duplication of articles and possibly getting caught?

Why not trying to spin complete WWW with WordAi, and creating 1 billion sites whilst avoiding duplication of articles and possibly getting caught?

Why not get better articles written and always out rank your competition, of course by taking some cues from the already existing one's?
 
Maybe if the domain was in your hands. But why were they deindexed? Maybe the content was stolen from elsewhere.
 
Aside from raping his dead body after he's already been through the ringer, it's also not a good idea because of what linksmaster said. He will likely keep a new site from being indexed so he can copy that content onto the new one before deleting the old one. I don't see much benefit here anyway to be honest, plus it's kicking a man while he's down. Being aggressive is good business but there's no need to be a snake.

This. It's not like he was neg seo'ing you while he was competiting either. Don't be a snake as aforementioned.
