I've got a new client who has had a .com registered since 09, and someone came along and took the exact name as a .net. The .net is now outranking him for his business name (which is also the url)...does anyone know if this is this kosher from a legal standpoint? I'm wondering if a cease and desist would work?

If it has his brand name it may be infringing on his brand name. You're going to have to look at the legalities within your local government because this will change from place to place.

The same situation with me. I registered serpenabler.in and someone else registered .com . I have all gmail, FB, twitter, You tube and many other profiles with the name "SERPENABLER" . He doesn't have such that's minus point for him. I think you should stick a notice on a site that you don't own .net domain and you would not be responsible for services purchased from .net .
