Character name, is this legal?

    There is a minor character in a tv show that has had about 20 seconds of overall footage in the 4 series of the show. for this example its name is "stomper"

    Would i be able to take the character's name and make a domain like www.stomperfly.com? or is this breaking some sort of trademark use or something?

    i was planning to use the same colour scheme as the character for the site and maybe the back of the character to avoid trademark disputes, what do you think?

    is this legal?

    I doubt they made the Tv character a trademark..so imo is 99% safe

    Do a search and see if the name is trademarked...
    The applicability of the trademark (if it exists) isn't automatic, either. It needs to be relevant to the category. If they registered a trademark in a 'cartoon character' category (assuming one exists) and you wanted to use the same word/term/phrase in a 'boat building company' category, you would have no issue.

    So in a nutshell - it's probably not TM'd, in which case you're fine, and even if it is TM'd, it depends on how you plan to use it.

    Its just a random name. I dont see a problem with that. Justin Bieber does that mean you cant buy the domain Justin or Bieber? No

    if the domain name is available is fair game. think about it. if it was TM'ed the domain name would not be available.
