Cease and Desist notice received from Facebook in listing on Flippa.

    Hello..

    Does Flippa not allowed sites which sells facebook or instagram services? I know that there is a trademark with domains which contain trademark but I am not sure for this. I've heard that sellers get cease and desist notice from Facebook/Instagram in their listings on Flippa.

    Just type in "instagram" in the Flippa search there is a lot of people selling those sites, ive seen some get sold.

    if your site makes good money just hide the url etc.

    I don't know/think Flippa will care, but Perkins Coie (who represent Facebook et al.) certainly will and are pretty aggressive.

    In general, it's not a particularly good idea to use a term in your domain from a litigious company (e.g. ebay), regardless if you are selling on Flippa or not. One day you'll get a very expensive lawsuit and will regret the few hundred dollars you may have made on Flippa in the short term.

    Yes I know about the trademark in the domain but one friend of mine got the following message:

    Your listing has been cancelled for the following reason:


    Cease and Desist notice received from Facebook / Instagram - Terms of Use breaches. Flippa Credit refund issued in this instance only.

    If you believe a mistake has been made, please let us know why by replying to this email.

    He never used trademark domain but the website sells social media services. I'm asking what is the problem for flippa about selling social media services.

    You have their trademark in your domain name, you can't use that without their permission or licensing the use of the trademark.

    Unfortunately they have a pretty clear and easy to win court case here...

    This is true but i think that satez asked something different.
    Flippa cancelled an auction which hasn't trademark because he just selling social media services.
    It's a little bit strange but there is no question about trademark on the domain.
    Can this be happening?Flippa withdraw auctions from websites that selling facebook or instagram services?

    I don't think they're cancelling due to the advertised activity in those sites, I think they responded to the Facebook trademark issue. Only copyright and trademark are strong enough to get a site removed like that, because of the DMCA's draconian terms...

    Then, remains strange that Flippa canceling auctions on websites which sells social media services since there was not trademark on the domain..If someone has opinion about this let us know..

    Yeah selling likes, pins and fans have been a violation of TOS for years. Flippa probably received a letter from P&C with verbiage like the following:

    "Specifically, you sell mass Facebook Page likes ("fans"), and in
    the course of delivering your service, have utilized Facebook user accounts to "like" pages
    without their consent. These activities, including the monetization of "likes" on Facebook on
    and through your website, domainname.tld, are prohibited by Facebook's Statement and
    may violate state and federal laws prohibiting the initiation and sending of spam as well as the
    unauthorized access of` protected computers."

    Flippa providing a selling platform for websites offering this service would make them partners. P&C is taking out the snake by cutting off its head. I'm sure it won't be long before BHW receives similar notices requesting them to stop sales.

    Do you believe that it has already taken place or it will take place on Flippa for all social services like youtube, pinterest etc?

    even blogspot URL's are not allowed for listing's in flippa.

    I see sites selling social media likes, fans etc all the time on Flippa, so there is a rule against it, it's not enforced.
