doesn't press charges? If i say, download a picture and then watermark it and upload it to a site, can the state still press charges even if the person never finds out?

I don't think, but how can you be sure the owner will never notice it?

The simple answer is no you cant. How can the state know if you are not granted permision to use said material by the copywrite owner ? :) The owner must press charges for you to get in trouble.
