Hi If a network wont pay you, are you entitled to get all the data that the person filled in on the offer? If they will not pay you for the data surely that data does not belong to them and they should return it to you? Also if they say" We have proof about this and that" And i say" Can you please send me the proof" And they say" We would not terminate your account without proof blah blah" Thanks

Kinda agree, but at the same time, you obviously broke the rules in some way, or they wouldnt have banned you. And my guess is you know that you broke the rules. My advice, let it go, nothing good will come out of it.

I think its more unfair if they wont give proof that you broke the rules and keep all the earnings, that is unfair to me

OP this is a crappy situation, makes you wish there was some kind of union for affiliates so things are more fair.

I have asked for proof and which campagian this has come from but again no response, Why dont they just show me the campagian where this alledged fraudulent traffic has come from? You maybe surprised which network this was from also, but until i get answers i wont name them for now, They say the proof of the fraud leads in my stats, All i can see if my sign ups and how much i have earnt. They say" do you think I would do this without proof" I asked nicely, " Can you send me the proof" Get told its not the answer they were looking for!! Where do i stand legally? Surely i am entitled to the data from these leads if they are not going to pay? Can anyone clarify that?

I think making a stand is better, fair and sqaure if they could give me the proof for the reason they are not paying, but why should i take their word for it?

be as professional as possible, if there is proof, then you need to see it, to figure out which "employee of yours" is short-cutting his work.. because thats obviously someone you dont need on your team.

if this doesnt make sense, then forget the money

Read their TOS, you might find their word is final, regardless of their reasons.

Then they should give the leads back which they have not paid for as they belong to me, right or wrong?

As others have said here... Just let it go, you're not gonna win this one.
It sounds to me like you did break the rules, but you want them to prove
    it.

I would look at my whole business model, and restructure it so I own the
cards. This would probably mean building a list first using what ever traffic
you use, and then use a newsletter to convert prospects into buyers. In
that way, you only ever send quality and recyclable traffic to the CPA vendors.

it really doesn't matter to them what you think they should do. you have no leverage at all here.
