Can I use a celebrity's photo in my ad to my free website?

    Ok, here's a question....
    I want to put an ad on sitescout using celebrity images. The ad will link to my website, that doesn't sell anything, but instead, just has a link locker in certain spots........is, this, ..legal?

    If I take a pic of you and post it on a free site as an ad leading to a porn website, what would you do. Sue the ad creator right?

    Anyway, that is how I think. It may be legal but I do not think so.

    As long as you dont make anything profit from it, that is ok. But if you just try to defame the celebrity or make spam with those pictures, you may be fined heavily.

    So Just be careful. But if you are not making any money from advertising, you can do, it is just like we use celebrity pictures in youtube to get traffic, so as long as that,i know. You can do it. since you are not making any money from it.

    Why do you even need ask this. Of course you cannot use the image unless you pay the photographer AND the celebrity.

    I'm kinda interested by this, isn't this the business model for Access Hollywood and TMZ? Taking photos and videos of celebrities without them agreeing to it? I thought if you are in a public place, you can be photographed, same goes for famous people and "being in the public eye". I'm not quite sure how far this extends though.

    I honestly have no clue though, this is just a topic that interests me.

    Heytherejake, that's true. You can legally take pictures of someone and post them on the internet. If you're in a public place you cannot expect privacy. However, what I think OP is talking about is using pictures made by other photographers commercially which is illegal. The photographer and/or the model (who signed a contract allowing the pictures to only be used for certain things) can sue you and win. My roommate is a photographer who's sent out a lot of DMCA requests and he wins 90% of them without needing to send a second email.

    Also, if you use a getty images image on your site or ad without paying for it they will send you a claim for about €450 and the price of the picture so I'd advice against that.

    I think this is the way. One of my friend use these resources. He just put a caption below images saying ( Image Credit: Source Name)

    The problem isn't that you are using a photo of a celebrity, it's that the photo was taken by someone else and it belongs to them. So it is illegal. Chances are the person would never know you are using it, but still a risk I think.

    As long as you own the picture then you are free to do as you wish

    It depends on a photo, photo usage and who has the rights to it.

    If you really want to go legal, you should contact rights owner. :)
