Can i give fake details to namecheap so it brings fake whois data in case of lawsuit?

    I got a lawsuit for using an emd once for a branded kw.

    now it was a great earner so im thinking of doing a new domain which isnt emd and doing an article for that kw so they have less gorunds for suuing.

    in the cease and desist letter i got last time it said it was cos i was using the emd without giving them credit and advertising products other than theris.

    so im thinking if i do it again ill do it without emd but in case they check whois i have to have new info cos they said if i try and pull anyhting agian under my current name/detials they will fuck me up.

    now i dont have any charitable friends who would do this for me and my mother would be no good as same second name in case they investigate.

    so can i jsut makeup fake whois data??

    one probm ive had in the past wht uk domains is i have to register with nomit and they require real address but i think maybe jsut giving a real addres of any real addy would be ok cos they didnt send me anything the computer just looked up the address to chekc it was real.

    thoughts?

    I always use fake Whois data and I've seen many domains with fake names and addresses. Some are really funny. I don't think there is a problem with this, but again, I'm not sure.

    Why don't you set up a blogger account and then rank for it?

    Back up the site every now and then just in case they take it down.

    If the blog gets taken down just restore it.

    Rinse and repeat.

    It is fine, the only problem you might have is if shit goes down, the domains not registered to you....so you wont technically own it, and you will have no rights regarding it. If they want proof of identity for whatever reason, you will need to provide them with fake documents with the fake name you used on it or they just take your domain on you.

    If you get caught providing fake info, you are violating the TOS, so technically they can confiscate the domain on you.

    well i wuldnt go so far as provigdign more faked documents- ie increasing my fraudulent behavoir, id jsut let the site go and start a new.

    this is only a precautionary measure, 1st i think they wont get on my case if its not emd but jsut in case they do then its not someone they already have a track record with or so they think so then they would do another cease and desist and id take it down.

    Yeah you'll be fine, the only thing at risk is losing the domain name/site.

    I never understood why people try to get around laws. I'm all for bending them until they scream, but outright infringement and falsifying legal documents? I hope you get caught, again.

    The short answer is of course, you can give any information false or not to companies online. Then you could use a whois proxy, these companies withhold your contact details and register a domain in their name. However if you are doing anything that is unlawful those whois proxy companies would have all the cause to turn you over to the authorities.

    Just understand that perfoming transactions online leaves traces and it'll only be a matter of time before the trail leads to your front door.

    Just as a quick example, I got into trouble on mirc ages ago. Thought I was safe until I got that knock on the door.

    well this is part of what im trying to gather. is it BENDING TOS of service which would just get me banned form hosting and lsoe my domains or would it be illegal such that i could be prosectuted.ie bad enough theyd chase it up to 'exact the law'.

    i dont like to break the law cos i like to sleep well at night hnce why i do blackhat and am not a drug dealer.

    in terms of what ill be doing wiht the domain it is just writing a 'review' of a specific branded company and getting the adsense from it once it ranks. if it isnt a emd like before -cos thats the main reason they were angry- i dont see them getting mad about it. even if they do id have more basis to plead innocence cos im gonna be doing reviews of other companies to. ill put a cpl others up and have a general blog related to the niche to make it less focused on that specific branded kw like it was before. so the site will be gnerally about the niche and then 'oh lok jsut one article for this specifically juicy kw'.

    Look bro, don't even think about it.

    Even with fake whois, it's easy to find the true owner. They can go to the hosting company or see who paid... etc. You would look really bad if this is exposed in a court of law.

    It may be owned by one of the parents, possibly. ;) Or the PP account may belong to one of the elder siblings...

    Someone could get into real mess if the brand name blows a fuse due to OP's activity. Else, no worries until the next time when the brand name really blows a fuse. Then it could be anything between C&D and confiscating the site, and a real soap opera.
