Can a company sue you for mass messaging on their platform?

    Hi, can a company sue you if you are mass messaging (trough their platform) with 3k accounts peoples? Sending like 60k messages a day across all accounts redirecting to free offers like email optin (then an affiliate link) or even growing your own mail list? I understand if we talk about facebook or other super big companies of 10+ bn you wont even get noticed in the load of messages thery get everyday. But what about some platforms which are worth 100m to 10bn and they do not handle so many messages a day or their message function it's a secondary/third feature? Hence they'd see a spike of 50%+ in messages and instantly discover it's "artificial".. ? Could they sue? If yes, for what?

    1) Have you ever experienced such thing? a C&D for "spamming"? If yes, when? which platform?

    2) So I'd just get a C&D and if I stop nothing happens?

    3) If I get caught promoting something different after a C&D but it's always me, in the same way, can I be sued?

    Very rarely this done happen, but you would simply get a Cease & Desist in your mail telling you to halt, change and get out of that particular promotional message.

    Hasn't happened on a few sites, but the majority of stock corporate monopolies do send them out periodically.

    Facebook, LinkedIn, WhatsApp, Instagram, SnapChat & Reddit have been known for mailing them out.

    IMO, the company can sue you, if they think their reputation or through your mass mailing they got hit with too many complaints or even getting media attention on the issue. In this scenario, yes you can be in trouble.

    If your breaking there tos then sure they can issue a c&d.

    Well that's not about "opinions" but about law. If they can successfully sue someone for mass messaging then they can do it even if it doesn't get any media attention or does not get their reputation bad or too many complaints. For ex. if you were to mass messaging on linkedin soft selling trough content marketing your useful software you would NOT 1. get media attention 2. not getting any complaint from users 3. not harm their reputation.

    So my question at this point is: can you get sued successfully anyway?
    And my other questions still not answered at all

    it's up to you, you either cease & desist or don't give a fuck, the course of action what you should take, can depend on your location, if you're located in Best Korea, you can continue whatever you were doing, if you reside in the US, you better do what you have been told in the letter
