C&D From Cityville Owners... What To Do?

    So Host Gator sent me an email today saying Cityville owners want me to C&D a site that I have just set up with their game name within the domain. At this point I don't want to be sued but am pretty bummed since now I rank #2 in Google for this keyword and have already got about 10 searches within last couple hours so with a full day I would probably be receiving 50 searches a day... what to do?

    is this for real.. i just started linkbuilding my cityville site too..

    so all domains that has cityville in it will get scrapped? i cant bleieve this

    Well, I always wonder how FarmVilleSecrets d.o.t com still survives.

    It looks like the same owner has another backup site, which is called FVSecrets

    there's a lot of sites on the first page with cityville in it

    i.e. the #1 guy is cityvilleguide dot com. i don't see him taking his site down.

    Ask yourself why the vendors are not even using the trademarks in their domain names anymore. Zynga have gotten mighty aggressive lately.

    Hey there guys,

    I inquired about this matter at FarmVilleSecrets contact page.

    Here's the reply:

    "Hi,

    I understand that your situation involves legal issues with Zynga whereby you may have received an email from their lawyer insisting that you cease what they deem as infringement on copyright. Do not worry for you are not alone. To be perfectly honest, we have over 1000 affiliates, many of whom they have not contacted despite them being an affiliate for many months. Other affiliates which they have contacted have not had any action taken against them, other than the initial 'scary' email sent to them.

    If needed, here are some common steps you can take to resolve it:

    1. Reply and ask what exactly is infringing for you to remove / change / etc.

    2. Farmville in the domain is a common complaint. You can instead change your domain name and get around it by using FV or fmville (for example).

    3. Host your site with companies outside of the US in countries which DMCA does not apply (such as Canada).

    4. Use the new logos if need be (Yellow FarmVilleSecrets logos at farmvillesecrets.com/affiliates).

    In all honestly, this is a minor hiccup and you can rest assured that this will be resolved easily. This is because:

    1. You are only an affiliate. If there are serious implications, I as the publisher will be the one shouldering the blame.

    2. I have over 5 years experience selling products in niches such as World of Warcraft and using the name warcraft in my domains... and I'm still selling them. FarmVilleSecrets will be no different.

    3. The lawyers are a third party hired by Zynga and lack decision making powers. Their letters are also generic and sent out word for word to all affiliates. They are just shooting in the dark and hoping to scare affiliates in taking their pages down.

    I also got this shit..
    From ZYNGA TEAM themself. I asked what the problem was.. And it was because i have taken a original cityville picture from net and put on my site..

    It havenĀ“t a shit to do with my domain.. Which is also "cityville.....blabla.info"

    So .. :)

    I myself have received them on all my such domain, I don't give a shit. Just host outside US and get domain from internetbs.net

    btw the exact solution is offshore hosting,

    I got this too. I wasn't even USING the domain yet. It was only 3 days old. This happened last month too
