By posting a phone number on an online classifieds site, are people opting in to SMS spam?

    I watched a video for SMS blasting software, they state in the video, that by posting your phone number in a public classified ad, you are opting in to marketers, is this true? If you think it is, can you cite a government site to back up your claim? I've looked at the FCC website and couldn't see it prove or dismiss this idea.

    I doubt they meant literally "opting in", they just mean in effect you are opting in. Thats why you spell out your number in an online classified ad.

    If you looked on FCC and couldn't find anything, this kinda confirms what I'm saying. Perhaps someone here knows different though.

    If he didn't mean figuratively opting in, I would stay away from that provider.

    There is no figuratively opting in. It's a legal issue, and if they are not opting in by publically posting their phone number online, then I won't use this software. I don't want to get in trouble and use the excuse "but the man on the internet said it was legal!"

    Only if the terms of service for posting on that site say they are opting in to receive SMS.

    Of course they are not opting in. They are posting their number on the site in regards to the classified ad. If they knew they would A) opt in to SMS spam or B) People use a scrapper and steal the phone numbers and use them to send spam.... they wouldn't post the number there, would they?

    Under certain countries spam regulations, the public availability of an email or phone number means it is 'public domain' - and could therefore have been found in the natural course of business marketing. It's the same if you get a business card etc. Any publicly available information can be used to initiate business contact if your country allows this. Some countries also differentiate between businesses and consumers. Consumers generally have more rights to privacy than businesses.

    But... That doesn't mean its OK to spam them, and you'd have to include an immediate opt-out option at no cost that's easy/instant to access. And you'd also have to be very careful to limit the volume to minimal levels or you'd obviosuly get complaints.

    You need to check with your country's spam reg's.

    I think the are not opting too. They would post their number just to communicate with the interested persons (in their ad) or to reply to the particular ad. But opting them in and then spamming is not good activity I think
