Can I buy a Canadian (.ca) domain even though I'm not Canadian?
Is there a way of getting around it?
As far as I know, no. You have to be Canadian in order to buy Canadian domains (well, at least legally anyways).
Any idea what the penalty is for getting busted? Are we talking a fine or are we talking they just take the domain off you?
You can have a Canadian to buy it for you, and host it for you too I guess.
That's what I'd do. Find a Canadian who would trade / take some cash. If you're building a new site - geo targeting to Canada in WMT works really well. If it's for a PBN you could even offer someone links to help you pick it up.

You either need to be a Canadian PR or citizen to buy domain. If you're neither one of them, you could loose the ownership of the domain.
I think euro DNS may help you get .ca domain. Try to search it.
