Brand Name Violation for Domains

    What is brand name or trademark violation?
    Let's say I want to create a site for the keyword "McDonald's French Fries". Will I get in trouble for setting up an emd site mcdonaldsfrenchfries.com?

    How strict is this law?
    How about if I want to set up an amazon affiliate site for dell monitors. Can I setup a site dellmonitorsreviews.com?

    yes it is a violation and they have the lawyers to prove it. They have nerds in their HQ that search all day long for stuff like this.

    You get in trouble if the patent holder wants to make trouble. I don't think it is worth it, unless you are a very short-termer.

    So basically, emd promoting these branded products is out of the question?

    How about affiliates products emd? like articlemarketingrobotreviews.com or "affiliates site name"reviews.com?

    IM'ers seem to be more forgiving (search for bookmarking demon). They seem to like their name mentioned a lot in SERP. But it is on a case by case basis. If there are other hitching on the tradename, then probably you are safe (probably). At your own risk.

    Rule of thumb of running a business and legality.

    "If you think they can pay for it, then don't do it".

    Going against, Dell, Sony etc. anyone who has budgeted legal expenses not going to be worth it.

    The mom and pop shop across the street? Probably not.

    Just to expand on what I was saying, if you search for 'bookmarking demon' and then see all the SERP positions with domains like 'bookmarkingdemon-reviews' then you think it is a very popular product, and you gain trust in it and either buy it directly or through affiliates.

    So in that case, the owner of BMD loves you. But Toyota, Sony, ... different story. They have some hard arse lawyers sitting there, just waiting to justify their miserable (but expensive) existence.

    I think you are safe with most IM products, as long as you HELP them spread the word (and not criticize them).

    Also with big corporations, if they let you slide, and hammer down on another domain, they could be subject to charge of discrimination, etc. not worth it to them.

    None of us are lawyers (I think) so just take it as layman's opinions, and do it at your own risk.
