Brand Name Legal Issues?

    I found a good expired domain with a healthy backlink profile. However it is the name of a business that is still in business from what I can tell. The website is called something like "EZ4Store(dot)com". If I google its name it comes up on the first page even with google maps directions underneath, along with a ton of sites reviewing it.

    The business also has a facebook still active under that name. I dont know why the site was dropped but if I buy this as an expired domain is there a legal issue here?

    Redirect it to a review domain or something like that.

    Check the Trademark database. If not trademarked, then you are good to go.

    If it contains a registered trademark, forget it - you'll lose it anyway.

    Im not good with legal stuff. I can go to google right now and find a picture of the building with a sign that reads the title of the domain, without www or dot com... I assume thats trademarked then?

    Depends on how much money you are spending on this expired domain and what you are
    comfortable gambling with. It's definitely a nice domain for a redirect to another money site
    so you are looking in the right direction.

    There's a very big difference between a photo of a building with a sign, and a domain name containing a registered trademark. In large part it comes down to beneficial use - you don't make money from seeing a sign on a building (the trademarked item), but you certainly do by unlawfully using the trademark for your own purposes, ie, in a domain name.

    The law primarily seeks for things to be fair and reasonable - and a fair and reasonable person would conclude that a sign on a building is open to be photographed without 'using' the trademark, and that same person would also conclude that once you register, for your own benefit, a trademarked word for use in commerce, you are deriving a benefit from another entities trademark.
