I have a site which is doing quite well, it is (for example)...

    Keyword: walmart coupons
    Domain: walmartcoupons.com

I have a 10/10 quality score and am making a little profit.

TOS often say however that you cant bid on "brand name" terms which i am obviously doing... Hmmm.... has anyone any experience with this? Do they check? Do they care?

I've been slapped for that a time or two... they do eventually check it and then disable the ads. I've never lost my account that way though.

They check but most importantly walmart (or whoever) will check. you will eventually get a nasty email or letter threatening you from whoever's trademark you are bidding on. google will ban you eventually as well. if you cover your tracks well and have a way to get another adwords account, you can probably survive.

I've faked the referer to a WH site so "walmart" cant tell from that.

If however they go to Google and search for "walmart coupons" they could investigate it...

With Adwords they don't let you use certain Trade Marked names, the trademark i am using is not allowed in the ad copy but i have got round it and put "WalmartCoupons"

And i am bidding solely on the term "walmart coupons"

Why would Google band me? What have i done wrong here?

I haven't used the term on its own in the ad copy...

Just to clarify, i'm aware that this may be against the CPA/Affiliate networks TOS but it didnt cross my mind that Google would possibly throw the ban hammer at me, 3+ more ads come up for the same search

They didn't ban me and I used a company that was as large as your example... they just made me change the ads.

If Google receive a valid trademark complaint then they will stop your ads - there is a webpage you go to at Google that has a trademark complaint form. It would take the company to see you using their term in your ads and fill out a complaint form.
