Beating a company in google using its brand name in domain

    I've got a site that ranks on the first page of google for about 30 keywords grabing loads of traffic making a nice amount with the site at the moment but I am a little worried as I have smashed the company in question in to the ground with these keywords I am above them with all keywords I have targeted. Normally not a problem but the domain name has their company (brand) name in it in this format

    Do you think the domain is safe or when they realise whats going on will I be asked to push the domain to them? It is a company in my country.

    What do you think guys am I safe?

    Asssuming its a reasonably big company with a legal team then be prepared to lose your domain unless it is clearly stated you have no connection to them and could be argued you couldn't be mistaken for their site. It's a tricky one, but generally speaking if you recieve a C&D you won't want to fight it - especially if they can track you. If you really want to keep it, I'd suggest offshore hosting and an anonymous domain registration

    Mediaon.com are pretty decent for offshore. Although don't expect to be 100% anonymous - I've been tracked down before through my affiliate link even though my hosting and domain were completely anonymous.

    My advice would be ride the wave while you still can :)

    I got a cease and desist for rocking a similar domain and product. IF you are not in the U.S
    Canada, Australia, or UK i would weight you options as those countires come down the hardest. Profit VS> Risk!

    You already know the answer or you wouldn't be asking the question. To confirm - no you're not safe and if you're making money they can request what you earned PLUS what you cost them from lost revenue by creating your "consumer confusion". That term is very open to a very broad definition and trademark holders typically have lawyers sitting on the payroll with nothing better to do than pound small guys into the ground.

    That lesson cost me $180,000 but my insurance picked up $100,00 so I only had to fork over $80k. Good luck with your venture but that sort of legal exposure is silly when you can make a boatload of money without it IMO.

    couple of years ago, i was doing the same with pharmaceuticals, and i was first in google for couple of different keywords right before their actual company sites... what they did was a phony "domain name dispute" in which dispute nobody asked me anything about showing any documents or whatever, it was just the legal way to take all my domains that had their brand name in. they just transfered them to themselves and that was it. so basically if it is a big company that is concerned about their serp positions and you are before them...don't think that domain will be yours for long...

    Had a website with www.shinjiru.com. hadnt any problem with my spam complains. they dont ask any personal info. You can put NA at any field you want. Exact the payment way of course!

    try to keep anonimous to be safe
    one legal sue can bring all of your hard work vanish

    Is this only risky is you have the company name in the url? What about a website about insurance companies for example and you have individual pages about different ins companies and these happen to rank above the company for the company name KW?

    Disclaimers are your friend.


    Post it on a few places in your site. The legal team can still try to get you for copyright infringement but as long as you aren't using their images etc. You should be ok for at least a while. Check the company's website as well to their disclaimer and see if they state anything about it being used by another site.
