When the earnings from Social media are above the "tax-free"-limit here in germany, I need to set up a business, to stay legal and pay taxes, right? Without any exception?

So what I'm wondering about now is, in what way could I get into troubles? I'm talking about Instagram and I'm using the content from other people. Out of the Tos of Instagram, it's forbidden to post content without the approval of the owner.
So my question is, are there people that check stuff like copyright infrigements on social media, or is the only risk to get in trouble, with the original owners? Do I stay safe as long as I credit the owner?

Whats the best way to bank the earnings from SM, while paying taxes, without looking suspicious and making people observent about the own activities? In some ways I'm against the rules of IG, will this directly lead to conflicts with the law?

I need some enlightment and answers to my questions, it's pretty important. :)
