I'm thinking about creating an instagram automation service similar to instagress. I'm not sure exactly how instagress operates but it seems to comply with instagram because it uses their API. I know it is against instagram ToS to run bots like that but would I get into legal trouble for operating one?

    Thanks

No problem, just if the user accept to do some actions.
Example: You want to follow 200 users? Then, users click 'YES' button. There you should get a success token, and according to their API its legal to do this.
Just saying i need to clarify this info.
    Also, PM'ed you.

Okay, nice. I'm going to start developing this then. Another thing: on their client registration page, it says I cant use Instagram, IG, insta, or gram in the name of my application. How does instagress get away with it?

They are manitoring to all accoutns automatic. Today I tried to create new account whith these words and I didn't can. I didn't can make my status in IG with ad also. In my opinion they will find words in your application not instant, but through time it will be. So you need to solve this promblem now.

Instagress isn't legal. Their login doesn't use the OAUTH 2.0 where the IG login screen pops up with the scope being given. Instead, they're storing your username/password.

They're most likely using the back-door API or some sort of headless browser stack like Casper.JS/Phantom.JS or emulate an Android device. There are a few that do this.

To get legit with IG, you now have to submit a screencast of your app with all the functions. So getting token approve is much harder. Also, any scope like relationship needs a brand name backed to it. E.G. You're developing for a company like Heinz Ketchup that want analytics. So you get a letter from one of those Fortunr 100 brands to back you that you are developing a legit app.

There are people on upwork paying in upwards of $5,000 to get API token approved. Let Instagram Apps are iconosquare, klear, keyhole that only provide analytics. You can tell as they all use OAUTH.

Instagress uses Instagrams reverse engineered Private API. It is against Instagrams terms to reverse engineer or do similar things.
However, Instagram doesnt seem to mind too much as the service isnt being used for spam.

Spam would include mass commenting, DM or likewise. Instagress just follows/unfollows and some other basic functions.
