Anyone got sued because he used merchant's pictures of a product he promoted as affiliate?

    Has anyone had problems (legal problems or take down notices), when using product pictures of a product he is promoting through affiliate program. The pictures in question will be hosted on my site.

    The question is related to amazon affiliate as well as other affiliate programs. In their affiliate programs terms it says you can only use pictures from account manager, but these pictures are to small. And I guess they wouldn't allow hosting pictures on my site.

    So my question is can i get sued because of using product pictures to promote these product?

    I know i break copyright (as everyone else) but it doesn't make much sense, as most product owners want their product to be sold as much much as possible, and I as an affiliate am helping them to do so.

    No, only if its a image of a person / aka paid model maybe a issue.

    So there were no problems for affiliate product images, such as images from amazon.

    100% dependent on the TOS. If you're that worried contact a lawyer and ask them on a specific case by case basis.

    i hope not i use amazon images on my amazon affiliate sites. im not about to buy all the crappy products to take my own photo!

    Isn't the whole point of the banners and graphics they shove down our throats when we sign up for an Affiliate Program be that we use them? Does not compute... o_O

    I cannot ask a lawyer. They do not know enough about this matter.

    Regrading TOS, they do not allow hosting images myself without consent, but as far as i see, other sites and other affiliates are using their pictures.

    I promote 10000's of product, i can use hot-link images from their site (that is allowed), but i am not sure is it good for SEO?

    Having 10000 pictures on my affiliate site hot-linked from the same merchant , in my eyes doesn't make my site look good.

    Most of the Affiliation programs allows you to use their Graphics and other materials which can help affiliates. I think you should contact the Merchant and clarify.

    They say i can but they (generally) do not allow hosting images myself. And hot-linking may be bad for SEO.

    The pictures are not too small, you can get the full version of the picture, let me demonstrate.
    For example, let's take something random like http://www.amazon.com/gp/product/B007I2BZIE

    Using Firebug, it can be noticed that the image url is something like

    Code:
    [URL]https://images-na.ssl-images-amazon.com/images/I/51FQxoVrNsL._SL110_.jpg[/URL]
    By simply removing the ._SL110_ part you can obtain the larger version of the image. Voila:

    Code:
    [URL]https://images-na.ssl-images-amazon.com/images/I/51FQxoVrNsL.jpg[/URL]
    That's it.

    Or maybe not. Look at the big amazon affiliates sites like 3*camel, they hot link all images because of the amazon TOS and rank top.

    I don't see any problems using the product image of the product you are selling. As an affiliate you have the right to use these images, that is included in the TOS I assumed.

    Thanks. But many sites such as nextag actually host amazon images. Are you sure amazon TOS says you cannot host amaozn images yourself?

    In TOS it says i can just hotlink to their site, but this may be bad for seo, as i need to add 10 000 pictures/pages to my site.

    Was this product images or a images of a person.

    It was with the product images, I was promoting swipe bids at the time and I received a letter from their lawyer and also from my domain registrar.

    But it says swipebids company is scam. It is no wonder why did they tried to sue you.

    How did you saved yourself?
