    Utah is on track to have in June its first execution by firing squad since 1996 now that a judge has signed a death warrant for an inmate who chose that method over lethal injection.

    One of the curious aspects of the now scheduled execution of Ronnie Lee Gardner, 49, who killed a defense lawyer during a failed courtroom escape attempt when he was on trial for an alleged murder, is that choosing a death by firing squad is no longer possible in Utah.

    But the law outlawing firing squads was passed in 2004 after Gardner had already chosen the manner in which he wanted to be put to death. So he was essentially grandfathered into the firing squad.

    One of the nation's most famous executions in recent years was by firing squad in Utah when the state put to death Gary Gilmore in 1977. His death inspired Norman Mailer's 1979 novel "The Executioner's Song."

    Here's a snippet from NPR correspondent Howard Berkes' report for the network's newscast:

    The execution is set for June 18th but legal motions may cause delays. The last time the firing squad was used here was in 1996 and witnesses then said the execution was not as brutal or bloody as expected.

    But dozens of reporters from around the world descended on Utah to chronicle what most characterized as a barbaric remnant of the old west.

    The Deseret News reports:

    SALT LAKE CITY -- A judge signed an execution warrant Friday for Ronnie Lee Gardner, ordering that he be put to death on June 18.

    "I would like the firing squad, please," Gardner told 3rd District Judge Robin Reese.

    Reese heard last-minute arguments by defense attorneys hoping to convince him to change the sentence to life in prison. But the judge refused and signed the warrant authorizing the Utah State Prison to execute him.

    "There is nothing in the arguments today to cause further reflection," Reese said, adding that none of the new defense arguments constituted a legal reason to stay the execution.

    "It is my belief that the defendant has exhausted all legal remedies," he said.

    Gardner was shackled and surrounded by 11 armed guards during the hearing Friday. He had requested to appear via video feed from the prison, but Reese ordered him to attend in person.

    Gardner had the choice of being executed by lethal injection or firing squad. He is one of five of Utah's 10 death row inmates who chose death by firing squad at the time of his sentencing, so he is able to choose how he will die. Though a law passed by the 2004 Utah Legislature eliminated death by firing squad, those who had requested such a death originally are still allowed the option.

    Over the years, Gardner initially requested to die by firing squad. Then in 1990, he told a judge he preferred to die by lethal injection for the sake of his children, who "didn't understand" the firing squad decision.

    But in 1996, he told the Deseret News he would go so far as to sue for his right to die by firing squad because it was the option he always favored.

    "I guess it's my Mormon heritage," Gardner said at the time. "I like the firing squad. It's so much easier ... and there's no mistakes."

    I think there should be "an eye for an eye" justice. Whatever you did to a person, that should be your punishment, Like if you rape and kill someone, the same should be done to you. That would cut crime down ALOT

    Not hardly. Crime rates are still high in third world countries with harsh punishments and even more interesting is the fact that violent crime rates are higher in states with the death penalty.

    Interesting comment...but much along the lines of "who is going to kill the killer?"

    I tend to agree with Xplicit...an eye for an eye and all that.

    I would like to see the death penalty re-introduced in the UK for paedophiles, especially if DNA evidence exists. Am sure that will never happen though as we have far too many "do-gooders" in this country driving it to rack and ruin. :(

    Hmm.. as a mormon, I don't know what death by firing squad has to do with his mormon heritage...

    If it were me -- I'd like the option to die by being thrown out of an airplane over the himalayas. I can pretend I'm flying, and maybe some Tibetan would soften my fall, and I'd survive it by miraculous means, and live out the rest of my days in a Tibetan monestary.

    If ill get execution penalty some day for some reason i want that they shoot me with battleship atleast, or anyway with the biggest thing they got :p, that would be cool atleast.

    But that firing squad thingy sounds bit stupid :/

    Also Eye for Eye let us all blind. well something like that o_0

    That's easy. All he has to do is drop the soap in prison and they don't care who you are or what you look like. Some prisons thats a given.

    There's plenty of people out there looking for jobs to kill people OR severely hurt them.

    I don't get the contoversy. The guy requested this method of execution, both legal injection and firing squad produced the same end result, and the person he killed wasn't given a choice on how to be murdered.

    funny thing is in jail if you try to pull gay shit you get your fucken ass beat and kicked off the range. the whole rape thing in jail is overblown by media and hollywood. Ive been to jail and if you show any remote sign of gayness you get pc'd (protective custody) or you get treated like a bitch and have to clean up everything all the time. The only places where rape goes down is jail is the penitentiary and even then its not that common at all.

    I'd be terrible on a jury. I would be so suspicious of any evidence - but I guess if this guy killed someone in the courtroom then that's pretty cold hard evidence.

    God, I love living in Utah...

    Though, I'd be suspicious of anyone willing to shoot another human being who had not personally harmed him, regardless of what he'd done to someone else.

    Think about it. I'm pretty sure I could bring myself to kill or seriously harm anyone who hurt me or my family. But could you really shoot someone that hadn't done anything to you? Even if you knew he was a murderer? I'm not so sure.

    heh, guess there bringing the oldschool way of doing things back. wonder if they're gonna have hangings infront of crowds again like they did back in the day. well, i guess if you shoot someone in Utah, they shoot back.

    IMO they should just hang them and harvest their organs for law abiding citizens that need them.

    No appeals, no waiting, straight to death they should go.

    Though I myself wouldn't want a heart of a murderer.. But if I were on my death bed it would be a different story.
